Do you know what Probate is? If not, you’re not alone. Most people understand the purpose of a Will, but many don’t realise that a Will often can’t be executed until Probate is granted by the Supreme Court.
Probate is a legal order from the Supreme Court of New South Wales that authorises the Executor—the person appointed in the Will—to manage the estate and distribute assets to beneficiaries. In most cases, obtaining Probate is the first step in administering a Will.
Simply put, when a loved one passes away, Probate gives the Executor the legal authority to handle their assets, such as real estate and bank accounts, ensuring they are distributed according to the Will.
